PARALLEL TRADE PERMIT FOR A PLANT PROTECTION PRODUCT
Formulation:    an emulsifiable concentrate formulation containing 100 g / l penconazole identical to the UK reference product ‘Topas’ (MAPP No 09717).  Details of the traded product are specified in the ‘Confidential Conditions’ section (Appendix 3) of this permit.

EXPLANATORY NOTES
1.                   This is Permit Number 2687 of 2012.
2.                   This permit, other than Appendix 3, will be published on the website of the Chemicals Regulation Directorate of the HSE.
3.                   Application reference number COP 2012/01662.
4.                   This permit has been granted because the foreign product(s) to be traded has been determined to be identical in composition to a plant protection product already authorised in the United Kingdom (the reference product). If the authorisation holder of the United Kingdom reference product applies for a commercial withdrawal of that authorisation and the requirements of Regulation (EC) No 1107/2009 are still fulfilled, this permit will expire when the authorisation of the United Kingdom reference product was due to expire.
5.                   If the authorisation of any of the foreign plant protection products to be traded under this permit is withdrawn, this permit will only be valid for stocks of the affected foreign product sold or supplied in the Member State of origin before the date the foreign authorisation ended.  If the authorisation of the foreign product is withdrawn for safety or efficacy reasons, this permit may be withdrawn.
 
APPENDIX 1:  CONDITIONS OF PERMIT
Failure to comply with the following conditions will result in the withdrawal or amendment of the permit under Regulation (EC) No 1107/2009 and may result in other enforcement action, including prosecution.
 
Placing on the market:
Packaging:      The permit holder must only place this product on the market in the following containers:
i)                    1 to 10 litre high density polyethylene container.
ii)                   1 to 10 litre high density polyethylene / polyamide container.
Label:             The permit holder must only sell and supply the product with label text as detailed in Annex A to HSE’s letter dated 12 February 2013.
 
Use:
Field of use:    ONLY AS A FUNGICIDE

Maximum individual dose: 0.5 l product / ha           
Maximum number of treatments: 10 per year          
Latest time of application: 14 days before harvest
 
HOPS
Maximum individual dose:  0.75l product / ha           
Maximum number of treatments: 6 per year           
Latest time of application:14 days before harvest
 
BLACKCURRANT
Maximum individual dose: 0.5 l product / ha           
Maximum number of treatments: 4 per year          
Latest time of application:28 days before harvest
          
Operator protection:
(1)                 Engineering control of operator exposure must be used where reasonably practicable in addition to the following personal protective equipment:
Operators must wear suitable protective gloves and face protection (faceshield) when handling the concentrate.
(2)                 However, engineering controls may replace personal protective equipment if a COSHH assessment shows that they provide an equal or higher standard of protection.
 
Other specific restrictions:
For high volume application to roses, the maximum concentration must not exceed 150 ml product per 100 l water.
 
 
APPENDIX 2:  GENERAL CONDITIONS OF PERMIT
Failure to comply with the following conditions will result in the withdrawal or amendment of the permit under Regulation (EC) No 1107/2009 and may result in other enforcement action, including prosecution.
 
Label:
The permit holder must follow the detailed requirements of all relevant Parts of ‘The Labelling Handbook’ available on HSE’s website at www.pesticides.gov.uk.
The permit holder must not make any amendments to the label that are not consistent with the existing authorised use(s) and authorised label text.
 
Packaging:
The permit holder must design and construct the packaging and fastenings to make sure they are strong and solid throughout so they will not come apart and will safely withstand normal handling; they can be repeatedly refastened and the contents cannot accidentally escape; the contents cannot attack either the packaging or the fastenings or form harmful or dangerous compounds with them and they are unlikely to attract children or arouse their curiosity.
 
Mixing:
The permit holder must ensure that any plant protection or adjuvant product(s) recommended for mixing with this product are authorised or have an official List Entry for use in the UK (refer to HSE’s website at www.pesticides.gov.uk and ‘The Pesticides Register Database’ and ‘Adjuvant Information Database’). 
 
Adverse effects:
The permit holder must immediately notify the Secretary of State, the Scottish Ministers and the Department of Agriculture and Rural Development in Northern Ireland (care of the Health and Safety Executive), if they have any new information on the potentially adverse effects of the permitted product, or of residues of an active substance in that product when used in accordance with the conditions of this permit.  For those products permitted under Regulation (EC) No 1107/2009 permit holders must also tell the other relevant competent authorities of the EC Member States (a list of which is available from the Health and Safety Executive) and the EC Commission.  Failure to comply with this requirement is an offence.
 
Provision of information:
The permit holder must comply with all requests for information required by, or on behalf of, the Secretary of State, the Scottish Ministers or the Department of Agriculture and Rural Development in Northern Ireland in accordance with Regulation (EC) No 1107/2009.
 
 
APPENDIX 3:  CONFIDENTIAL CONDITIONS OF PERMIT
This section is confidential to the authorisation / permit holder.  Therefore, it is not available to those other than the data owner and has been removed
